JuWissBlog and Jean Monnet Saar warmly invite all interested persons to submit a contribution to our joint online symposium on the topic: "Protecting the Rule of Law in the European Union – Mechanisms and National Responsibility."
Who We Are
The JuWissBlog and Jean Monnet Saar provide young researchers with an open platform for scholarly exchange in Public Law and European Law. As academic blogs, they contribute to the Open Access transformation. JuWissBlog facilitates current scholarly debates across the full spectrum of Public Law and supports networking within the academic community. Jean Monnet Saar makes European Union law, European international law and developments in European integration accessible to the general public.
Topic
Protecting the Rule of Law in the European Union – Mechanisms and National Responsibility
The rule of law is a fundamental principle of the European Union and forms the foundation for trust between Member States as well as trust in the Union as a whole. Developments in Poland and – more recently – Hungary have once again raised the question of how to effectively enforce minimum rule-of-law standards in both European and national debates.
How effective are the current mechanisms for safeguarding the rule of law? What responsibility do national bodies such as courts, parliaments, and governments have? This symposium will explore these questions from both European and German legal perspectives. Particular focus will be given to the effectiveness of existing sanction mechanisms, the role of EU institutions, and Germany’s responsibility in the European rule-of-law dialogue. The aim is to identify current challenges and develop potential solutions.
The following list of topics makes suggestions, but is by no means exhaustive. Submissions on other relevant topics are explicitly welcome.

- The significance and effectiveness of the Article 7 procedure
- The role of the CJEU in protecting the rule of law (recent cases involving Poland and Hungary)
- The EU conditionality regime: EU funding as a means of enforcing rule-of-law standards (example Hungary)
- The Commission’s role in monitoring rule-of-law standards in Member States (e.g., infringement procedures)
- The role of the European Parliament in safeguarding rule-of-law principles
- The ECtHR and the enforcement of minimum rule-of-law standards
- German Public Law
- Rule-of-law requirements under the Basic Law for the Federal Republic of Germany in the context of European integration
- The role of the German Federal Constitutional Court in the dialogue on the rule of law between national supreme courts
- Federal dynamics in rule-of-law protection: The implementation of rule-of-law standards by federal states and municipalities.
- Manifestations of the rule of law in German constitutional law
- Rule of law in German and European foreign policy – The use of rule-of-law clauses in international treaties
Submission Guidelines
We welcome blog posts of up to 1,500 words.
